Nick Flanagan

Nick has extensive experience as an advocate in both civil and criminal jurisdictions. He has acted both for and against many of New Zealand's largest corporates on a wide variety of matters, as well as appearing for the Crown in serious criminal cases.

He frequently advises on general commercial matters for both private and public sector clients, and also has extensive experience in civil and criminal litigation arising from commercial regulation. He has argued commercial and regulatory cases before the District Court, High Court and Court of Appeal, and appeared as junior counsel before the Privy Council.

Nick is also a senior Crown Prosecutor, who regularly conducts jury trials for serious criminal offending. He has led the Crown case for charges including murder and blackmail. He frequently argues criminal appeals before the Court of Appeal.

Nick is a graduate of Harvard Law School (where he was a Fulbright Scholar) and the University of Canterbury (where he was awarded the 1999 University Prize for Law).

Sample Mandates

One particular area of Nick's expertise is in cross-border regulation. He has argued leading cases regarding the extra-territorial application of the Fair Trading Act, Securities Act and Civil Aviation Act, and is the co-author of the New Zealand chapter in the International Bar Association guide to international cartel enforcement.
